Surrogacy in Asheville, NC

In surrogacy, one woman carries a child for another woman who cannot conceive or carry a pregnancy to term. Surrogacy is an option for women who have anomalies of the uterus or who have had multiple miscarriages. It is also a good choice for gay couples who want a child with a biological connection.
There are two types of surrogacy: traditional surrogacy and gestational surrogacy. With traditional surrogacy, a woman is inseminated with sperm, either from the male prospective parent or from a donor. This results in a child with a biological connection to the traditional surrogate. With gestational surrogacy, a woman is implanted with an embryo, which can come from the prospective parents or from donors. In this situation, the child is not related biologically to the surrogate.
Surrogacy Laws in North Carolina
Like many states, North Carolina does not have any laws that relate directly to surrogacy. However, other laws seem to permit surrogacy agreements in certain situations.
The law can be found in the North Carolina General Statutes, Chapter 48 — Adoptions. In this law, compensation in any adoption or relinquishment of parental rights is illegal, yet there are exceptions to this rule. These exceptions include payments for the expectant mother’s medical costs and other related expenses.
North Carolina courts have not yet considered surrogacy in regards to gay, lesbian, or transgender couples. However, it is illegal in the state for LGBT couples to adopt a child jointly.

Couples who are planning on surrogacy often turn to a surrogacy agency to match them up with a potential surrogate. While surrogacy agencies differ on surrogacy requirements, many require vigorous psychological and physical screenings.
