Surrogacy in Long Island, NY
Surrogacy is often considered a family-building option for those who have been unsuccessful with other “first-line” methods of assisted reproduction. Women often choose surrogacy if they had recurrent miscarriages, difficulty carrying a child to term, or abnormalities of the uterus.
With surrogacy, a woman, known as a surrogate, will carry a child to term for a woman or a couple.
Two types of surrogacy are used today: traditional surrogacy and gestational surrogacy. With traditional surrogacy, the surrogate is inseminated with sperm, either from the male partner or from a donor. The surrogate will give birth to a child who is related to her, since her own eggs were used. Gestational surrogacy is more common today. In this case, the surrogate is implanted with an embryo. Because her eggs are not used, the child is no biological relation to her.
Surrogacy Laws in New York
According to Article 8 of the New York Domestic Relation Law, surrogacy agreements are against public policy, and thus are considered void and unenforceable.
This law also goes on to clarify that no money is allowed to change hands in relation to a surrogacy agreement, except for hospital or medical fees. Monetary surrogacy agreements are punishable by fines of up to $500 for those involved in the agreement, and up to $10,000 for those who arrange the agreements.
While New York law voids and penalizes surrogacy agreements, New York courts have ruled in favor of intended parents in regards to their parental rights. Courts ruled in the 1994 case McDonald v. McDonald that an intended mother was to be considered the legal mother of a child born through gestational surrogacy.
